National Enforcement Authority Finland mainly processes personal data in relation to its statutory duties, that is, the enforcement of obligations. In addition, we process personal data that is necessary for carrying out National Enforcement Authority Finland’s administrative duties and managing its employment relationships.

We process personal data in compliance with the EU General Data Protection Regulation ((EU) 679/2016) and Finland’s national Data Protection Act (1050/2018). Provisions on the processing of personal data are also laid out in the Enforcement Code (705/2007) and Act on the Protection of Privacy in Working Life (759/2004).

In accordance with the data protection principles outlined in the General Data Protection Regulation (GDPR), we only collect and process personal data for justified purposes and to the extent necessary for handling the matter. Ensuring the confidentiality and security of processing is the controller’s responsibility. Unnecessary data is either erased or archived as required by law.

Data subjects’ data protection rights in enforcement

According to the EU General Data Protection Regulation (GDPR), everyone has the right to obtain confirmation on whether their personal data is being processed by the enforcement service, as well as the right to obtain more detailed information on the processing of their personal data. If data is being processed, the data subject has the right to gain access to their data unless the enforcement authority has a legal basis for refusing to fulfil that right. In individual cases, enforcement authorities can have a legal right to suspend the fulfilment of this right for reasons related to securing enforcement.

When the conditions are met, the data subject has the right to have their personal data rectified and completed upon request, as well as the right to restrict the processing of inaccurate data. If National Enforcement Authority Finland rectifies your data or restricts its use on the basis of your request, it has an obligation to inform the parties to whom it has previously disclosed your data of the rectification or restriction. When making a request for rectification, you should nevertheless be aware that the decisions made by the enforcement authority in its enforcement duties are appealed in the manner set out in the Enforcement Code, and appealing against decisions made by the enforcement authority in administrative matters is provided for in the Administrative Judicial Procedure Act.

A data subject has the right to object to the processing of their personal data and demand the erasure of their data if the processing is not based on National Enforcement Authority Finland’s statutory duties.

Making requests related to the rights of the data subject

If you want to gain access to your data or exercise your other data protection rights, please contact the registry of National Enforcement Authority Finland’s Central Administration at hallinto.uo(at)oikeus.fi or PL 2, 00067 Ulosottolaitos, Finland. You can also make your request for exercising the rights of the data subject in person, by visiting one of our enforcement offices. We recommend the Ministry of Justice’s secure e-mail for sending confidential or sensitive materials. Instructions on sending secure e-mail are available at Oikeus.fi website.

When requesting access to your data, please bear in mind that National Enforcement Authority Finland may ask you to confirm your identity to guarantee the confidentiality of your personal data. You will be informed of the measures taken on the basis of your request without delay and no later than in one month from your request. If your request is unusually extensive, this deadline can be extended by two months.
